Analysis:
The right to freedom of opinion and expression was acknowledged as a Human right in the Universal Declaration of Human Rights which was conducted by United Nations on 1948, under the article 19; which indicated that every person has the right to provide opinions, ideas, and speak up and express it of the way they like whether by writing or speaking……etc.
The International Covenantal on Civil and Political rights (ICCPR) 2008 , supported this right and added some conditions or responsibilities to make it more fair and nobody gets hurt, this responsibilities need to be taking in the consideration as everyone is responsible of his/ her opinion, following are the international covenantal on civil and political rights amendments:
– Taking in consideration the right of respect others and their reputation
– And protection, national security, public moral or health ……etc.
Also, Freedom of speech is internationally supported by the International Covenant on Civil and Political Rights, the European Convention on Human Rights, American Convention on Human Rights, and the African Charter on Human and Peoples' Rights.
This right includes not only the right of expressing the thoughts, information and ideas but also it covered many aspects such as search, receive and instruct the information. The right to expression reached the international, regional and local levels and it is well recognized.
In this century you can see that the technology is making it worse for example under the right of freedom of expressions some people takes pictures to others in public places without taking any permission, this can’t be accepted as we need to respect others and their cultures.
The Right of freedom and speech has a strong relation with other rights such as to the right of fair trial and of court proceeding as both rights support the search and seek for information, generally as mentioned in above the freedom of expression and speech has limits specially when it comes to respecting reputation and the privacy of the others. However, it is happen mostly when it comes to criticize a public figure.
Media has a strong role in the right of freedom; it is using the right of freedom to represent the public opinion. Freedom of the press might obstacle the freedom of speech through quell the information and obstacle the voices of freedom of speech, on the other hand the freedom of press is one of the forms of the property right which summarized up the principle of “no money, no voice”.
Freedom of expressions and speech is essential in democracy; freedom of speech limits can’t obstacle the public discussion in Emergency time. Alexander Meiklejohn – supported the idea of linking between the freedom of speech and democracy, he define democracy as the self-rule by the people, and it is important to have an official election system, to have a clear and clean elections in front of public and no obstacles in reaching the information. In his point of view that the democracy will not reach the idealist level in the country if the government or people in power keeps faking the election system through suppression the information and not accepting the criticism, even if the reason of all of this might be for the benefit of the country and society but it is still against the idealist democracy.
The link between the democracy and freedom of speech is supported by Eric Barendt and he found it a modern democracy in Western. In addition, Thomas I. Emerson describes the freedom of speech as a balance between the change and stability.
Freedom of speech stops the revolutions especially when the people are upset with their country leadership or politics; it plays a strong role in building a stable and flexible society and decreases the bureaucratic.
The Worldwide Governance Indicators showed that the freedom of speech is one of the most indicators which strongly effect the quality of government and it was mentioned under the “ Voice and accountability”, it reflect the range of ability of the citizens in expressing their opinions , voting and free media.
Conclusion:
Human rights are created to give people the power, strength, ability, trust, overcome fears ……etc.
Freedom of speech is one of the most important rights of Human rights, it strongly effective to society and governments and develop the democracy.
Expressing your opinion with taking into consideration the limits and respect others is bless, it raises the ability of accepting each other’s, and builds a strong society. Freedom of expression is a goal of all nations, some countries apply it and others are not.
I hope in the future to have political systems supporting the freedom of expression and calls for it.
Finally, it is important to know that your opinion is important but also you need to feel that you are welcome to speak up, in daily life we see the freedom of expression and speech but in most cases the person who is speaking with confident and trust is someone has a power, which make this power is the source of his confident and I think this is not a freedom, the freedom is to express your thoughts, opinions and ideas comfortably to make a change and to gain the confident in believing that your voice will be heard not because you have a power or backup.
