Smoking in Florida
Almost every year, we hear more cases concerning how destructive tobacco is to our body and how harmful used smoke is to those who inhale its smoke (Mindifi, 2014). Cigarette smoking is the major single cause of cancer death in the United States. It is estimated that,''28,600 people in the state of Florida pass away from smoking. The U.S. experiences 443,000 deaths every year nationwide. There are 20 people who suffer for every person who dies due serious illnesses.
Lung cancer is just one of the cancers that can be caused by smoking. Recent findings show that smokeless tobacco products that have traditional been taking a backseat have slowly but surely started gaining a lot of ground especially among the youth. According to the American Cancer Society in 2013, it was estimated that about 174,100 deaths involving cancer will be directly linked to the use of tobacco. Smoking causes cancer in mouth, throat, lungs, nose, larynx, kidney, esophagus, trachea, bladder and many other parts of the body. Examples of smokeless tobacco are spit, dip, snuff, snus and chew and many others. These substances are not safe alternatives to smoking as many people would want to think (Carr, 2004).
These substances can lead to addiction. They are even more addictive that cigarette smoking. These smokeless substances cause many risky health problems to the body i.e. like cancer. Those people who engage in smokeless tobacco have a higher risk of getting oral cancer and at the same time a 60% chance of contracting esophageal and pancreatic cancer. It can also lead to stroke and fatal heart attack (Carr, 2004). Many people have the notion that using smokeless tobacco substances can help them to quit smoking but this is all wrong because as of now there is no scientifically proven evidence about this notion rather it should be noted that when one uses these products, it makes them to become addicted and most of the time will want to depend on it.
In Florida, 17.5% of the mature populace over 2,509,000 people is currently cigarette smokers. The popularity of cigarette smoking across all states among adults ranges from 9.3% to 26.5%. Florida ranks 18th among the states. Among youth aged 12'17 years, 9.5% smoke in Florida. The prevalence across all states is 6.5% to 15.9%. Florida is ranked 13th amongst all the other states. Amongst adults aged 35 years and above, over 28,600 have passed away as a consequence of tobacco usage every year (Mindifi, 2014). This has been on average, for the duration of 2000'2004. However other, 22 states have rates that are over 30 percent, 45 states are more than 25 percent, and every state is exceeding 20 percent. The state should come up with effective ways to fight with smoking especially among the youth to secure their future.
Smoking Regulations in Florida
It is unlawful for any person under 18 years of age to smoke tobacco in, on, or within 1,000 feet of the real property comprising a public or private elementary, middle, or secondary school between the hours of 6 a.m. Exemption from smoking regulation is also given to an enclosed indoor workplace, to the extent that tobacco smoking is an integral part of a smoking cessation program approved by the department, or medical or scientific research conducted therein. STAT.
A customs smoking room may be designated by the person in charge of an airport in-transit lounge under the authority and control of the Bureau of Customs and Border Protection of the United States Department of Homeland Security. These include private residences which are not commercially used to provide child care, adult care, or health care, or any combination thereof, enclosed indoor workplace dedicated to or predominantly for the retail sale of tobacco, tobacco products, and accessories, designated smoking guest room at a public lodging establishment and in any business that meets the definition of a stand-alone bar that otherwise complies with all applicable provisions of the Beverage Law.
Smoking, subject to some restriction is also permitted in customs smoking room in an airport in-transit lounge under the authority and control of the Bureau of Customs and Border Protection of the United States Department of Homeland Security. Each sign posted pursuant to this section must have letters of reasonable size which can be easily read. and midnight. The color, design, and precise locations at which such signs are posted shall be left to the discretion of the person in charge of the premises.

A customs smoking room may not be designated in an elevator, restroom, or other common area. STAT. Under the law of Florida, the proprietor or other person in charge of an enclosed indoor workplace must develop and implement a policy regarding the smoking prohibitions. Fifteen percent of the money is required to be allocated to a state tobacco prevention and control program by a constitutional amendment approved in 2006. ch. However rooms in which tobacco smoking is permitted must comply with the signage requirements as required by law. and midnight.FLA.
The policy may include procedures to be taken when the proprietor or other person in charge comes to know of the smoking violation in the enclosed indoor workplace. The person in charge of an enclosed indoor workplace may, at his or her discretion, post 'NO SMOKING' signs as deemed appropriate.A person in charge of an airport terminal that includes a designated customs smoking room must conspicuously post, or cause to be posted, signs stating that no smoking is permitted except in the designated customs smoking room located in the customs area of the airport.
The letters on the sign so posted must be of reasonable size that can be easily read. However, this rule does not apply to any person occupying a moving vehicle or within a private residence.Money from the state of Florida's tobacco settlement is initially deposited into a trust fund in the Department of Financial Services, and then transferred to a number of trust funds from there. Note: Florida was one of four states that settled separately in its lawsuit with the major tobacco companies, prior to the Master Settlement Agreement.
To help prevent cigarette-caused fires, except as provided in paragraph (f) of subsection 4 of section 633.042 Florida Statutes, no cigarettes may be sold or offered for sale in Florida, or sold or offered for sale to persons located in Florida, unless: 1) the cigarettes have been tested in accordance with the test method and meet the performance standard specified in subsection 4 of section 633.042 Florida statutes; 2) a written certification has been filed by the manufacturer with the Division of Alcoholic Beverages and Tobacco of the Department of Business and Professional Regulation in accordance with subsection 5 of section 633.042 Florida Statutes; and 3) the cigarettes have been marked in accordance with subsection 6 of section 633.042 Florida Statutes.Exceptions to the LawExceptions to this law include: 1) stand-alone bars as defined, 2) retail tobacco shops as defined, 3) designated hotel rooms, 4) tobacco manufacturing facilities, 5) customs smoking rooms in an international airport in-transit lounge under the authority and control of the Bureau of Customs and Border Protection of the United States Department of Homeland Security, 6) smoking cessation programs approved by the Department of Health or medical or scientific research conducted therein, and 7) membership associations as defined as long as no one is engaged in work.FLA.
SchoolsSmoking is prohibited in all enclosed indoor workplaces, including all educational facilities. It must also include a policy which prohibits an employee from smoking in the enclosed indoor workplace. The law of Florida generally prohibits smoking in enclosed indoor workplace. A customs smoking room may only be designated in an airport in-transit lounge under the authority and control of the Bureau of Customs and Border Protection of the United States Department of Homeland Security. 386.201 et seq. 386.203, 386.204 & 386.212 .
